These terms govern your use of Convoly. The short version: you are responsible for the messages your automations send, Meta's rules apply to you as well as to us, and you must not use this to send people things they did not ask for.
1. Agreement
By creating an account or using Convoly you agree to these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind it. If you do not agree, do not use the service.
2. What Convoly does
Convoly connects to an Instagram professional account you control and sends replies on your behalf according to automations you build. We provide the tool. The messages are yours.
3. Your account
- You must be at least 18, or the age of majority where you live.
- You are responsible for keeping your credentials secure and for everything done under your account.
- You must give accurate information and keep it current.
- Tell us promptly if you believe your account has been compromised.
4. Your Instagram account and Meta’s rules
Convoly operates through Meta’s Instagram API. Your use is therefore also subject to Meta’s Platform Terms, Developer Policies and Community Guidelines, and you are responsible for complying with them.
The messaging window is not optional. Instagram permits you to reply freely for 24 hours after someone messages you. After that only a message genuinely composed by a human may be sent, for up to seven days, using the human-agent tag. Outside those windows nothing may be sent.
Convoly enforces this on every outbound message and refuses sends that would breach it. You must not attempt to circumvent that enforcement, and you must not use the human-agent path for automated content. Doing so puts your Instagram messaging access at risk, and is a breach of these terms.
You are responsible for maintaining your own Meta app registration and permissions where required, and for any review Meta conducts of your use.
5. Acceptable use
You must not use Convoly to:
- Send unsolicited bulk or promotional messages to people who did not initiate contact.
- Send content that is unlawful, deceptive, harassing, hateful, or infringing.
- Impersonate any person or organisation, or misrepresent your affiliation.
- Collect personal data without a lawful basis, or in breach of any notice you gave.
- Ignore an opt-out, or continue messaging someone who asked you to stop.
- Probe, scrape, overload, or reverse engineer the service, or bypass any technical limit including rate limits and window checks.
- Resell or provide the service to third parties except as an agency acting for clients whose accounts you are authorised to manage.
You are solely responsible for the content of every message your automations send and for having a lawful basis to contact the recipient.
6. Your content and data
You keep all rights in your content. You grant us the limited licence needed to host, process and transmit it in order to run the service. Our handling of personal data is described in the Privacy Policy, which forms part of these terms.
7. Fees
Where a paid plan applies, fees, billing period and any taxes will be shown before you subscribe. Fees are non-refundable except where the law requires otherwise. We may change pricing on reasonable notice, effective at your next billing period.
8. Availability
We aim to keep Convoly running but do not promise uninterrupted or error-free service. The service depends on Meta’s APIs and on third-party infrastructure, and may be affected by their outages, rate limits or policy changes — including changes that remove functionality you rely on. We may modify or discontinue features on reasonable notice.
9. Disclaimer
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that your use will comply with Meta’s policies in every case — that remains your responsibility — nor that your Instagram access will not be restricted by Meta.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, revenue, data, goodwill, or for loss or restriction of your Instagram account or messaging access.
Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
11. Indemnity
You will indemnify and hold us harmless against claims, damages and reasonable costs arising from your use of the service, the messages you send, your content, or your breach of these terms or of Meta’s policies.
12. Suspension and termination
You may stop using Convoly and delete your account at any time. We may suspend or terminate access if you breach these terms, if your use puts our platform access at risk, if required by law or by Meta, or if we reasonably suspect abuse. Where practical we will give notice and an opportunity to fix the problem first.
On termination your right to use the service ends. Data handling on termination is described in the Privacy Policy.
13. Changes
We may update these terms. We will revise the date above and, for material changes, give notice in the product or by email before they take effect. Continuing to use the service after that constitutes acceptance.
14. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute, without regard to conflict-of-law rules. This does not deprive you of protections under the mandatory law of your country of residence.
